WEEKLY: Failure of the Clarity Act, Zcash surge, and Poland losing $230M in crypto

Market Analysis

September 21, 2026

This week in the crypto market passed in a struggle for key legislative initiatives and the recovery of individual sectors. The main event was the consideration of the Senate bill Clarity Act in the US, which was intended to define transparent rules of the game for the entire industry. Alongside regulatory pressure, the market experienced a high-profile capital flight in Europe and an unexpected rally of privacy coins.

Over the past five days, investors' attention was glued to Washington, where the fate of American regulation was being decided. Meanwhile, European countries faced the consequences of insufficient control over crypto transactions, and amidst a general lull in altcoins, individual projects demonstrated rapid growth.

Bitcoin holds its positions

The main cryptocurrency demonstrates consolidation in a narrow range following previous fluctuations. Large-scale sales by major holders have not been recorded; however, institutional investors have taken a wait-and-see approach ahead of the announcement of new macroeconomic indicators in the US. The current trading volume indicates low activity among retail traders, keeping the rate from sharp movements in either direction.

Senate failed the Clarity Act

The Clarity Act bill, which was supposed to delineate the powers of the SEC and CFTC and create a clear regulatory framework for crypto companies, did not gain the necessary number of votes in the US Senate. The main obstacle was disagreements among lawmakers regarding the regulation of DeFi protocols and stablecoins.

The failure of the vote postpones the adoption of the long-awaited specialized legislation indefinitely and leaves the market in a state of legal uncertainty.

Polish police lost $230 million

Law enforcement agencies in Poland faced a serious scandal after discovering a leak of cryptocurrency assets worth approximately $230 million, which had been seized during previous investigations.

According to preliminary information, the incident occurred due to improper storage of private keys and flaws in the internal security protocols of law enforcement agencies. A formal investigation into the disappearance of the funds has been initiated with the participation of international cybersecurity experts.

Zcash demonstrates a rapid rally

The privacy cryptocurrency Zcash (ZEC) showed double-digit price growth against the backdrop of a network update and increased demand for enhanced privacy tools.

An additional driver of growth was the increase in trading volumes on Asian platforms and the closing of short positions by large traders. This rally highlighted ZEC among the majority of altcoins, which traded in a sideways trend throughout the week.

Monitoring is being tightened in Ukraine

The Ukrainian crypto market faced further tightening of financial monitoring by the banking sector. Financial institutions intensified checks on P2P operations and transactions related to the purchase of digital assets, explaining this as compliance with anti-money laundering legislation.

Representatives of the local crypto industry note that this creates additional barriers for retail users and forces them to seek alternative ways to convert assets.

Lightning Network nodes under attack

In the Bitcoin ecosystem, an increase in targeted attacks against Lightning Network node operators has been recorded. Attackers exploit vulnerabilities in channel protocols to temporarily lock funds and forcefully close routing channels.

Developers urge operators to urgently update software to the latest versions to prevent potential losses.

Kursoff's Opinion

This week's events clearly demonstrate that the crypto industry remains hostage to regulatory delays and systemic infrastructure risks. The failure of the Clarity Act in the US highlights the lack of consensus among politicians regarding the future of digital assets, which holds back a new influx of institutional capital.

At the same time, the incident in Poland and the attacks on the Lightning Network emphasize that even government agencies and leading layer-two technological solutions are still vulnerable to the human factor and technical flaws, meaning security and transparency will maintain decisive importance for the further development of the market.

The failure of key bills and infrastructure incidents shift the market's focus from rapid growth to resolving fundamental security and legalization issues.
